Butte County's District Attorney now says he is seeking the death penalty for the suspect in the sniper-style murder of a Chico man.
Jeffrey Menzies is accused of shooting 26-year-old David Yang in September of last year.
Police say he hid in the brush near the intersection of Bruce Road and Highway 32, and shot Yang because he was the first person to drive by.
On Wednesday, District Attorney Mike Ramsey accused the defense of dragging their feet ... for asking the Judge to push Menzies' trial back to July of 2013.
Ramsey charges that it's an attempt to deprive prosecutors of their main witness, who is in the military and is scheduled for deployment at the beginning of the year.
Menzies ... who is now represented by two attorneys ... will be back in court in two weeks to set a new trial date.
He was originally scheduled to stand trial November 5th.###
