A Chico man affiliated with a criminal street gang opens fire on a family in the drive thru of a fast food restaurant Thursday.

It happened in the Carl's Jr. drive-thru on the Esplanade and East Avenue around 1:40 Thursday afternoon.

After an altercation on East Avenue, a white SUV followed the family's minivan to the drive-thru, exchanged some more words and opened fire.

A 23-year old man in the passenger's seat was shot in the leg, and taken to the hospital with non-life threatening injuries.

The woman driver and her baby daughter in the backseat were unharmed.

Road rage could be to blame.

After a one-hour manhunt, Chico Police arrested 25-year old David Martinez of Chico for attempted murder.

Martinez tried to discard his handgun, but police found it a few blocks away.

Chico Police say Martinez is affiliated with a local street gang.
